Please read these Gorilla Labs Online ("GLO") Fan Art Guidelines carefully because they affect your legal rights and obligations. Your submission of Fan Art (defined below) to Under My Gorilla Studios ("UMGS") means that you fully understand and accept these Guidelines and UMGS' Terms of Use as a legally binding agreement governing your submission. We may revise these Guidelines by updating this posting from time to time. You should visit this page regularly to review the current Guidelines. Your continued submission of Fan Art will be deemed as your acceptance of any revisions.
1. Must not infringe upon or violate the trademark, copyright, or common law rights, or violate the rights of privacy or publicity of, or constitute a defamation against, any person (living or deceased), or violate any other rights of any person or entity.
2. Fan Art, including any use of UMGS Content, must not include anything that is: (a) exessively gruesome or violent, hateful, or scat related; (b) promotes hatred, or harm against any group or individual; (c) unlawful; and/or (d) disparaging to UMGS and/or GLO or is inconsistent with the positive images and/or goodwill to which UMGS wishes to associate (at UMGS’ sole and absolute discretion).
3. Fan Art may not be subject to, or be within the parameters of, any performing arts union or guild. Under no circumstances will any compensation, such as payment, residual, royalty, reuse, or similar payments, be payable to anyone by UMGS, regardless of the manner and the extent to which UMGS elects to exploit the Fan Art or any portion of the Fan Art.
4. If any real person, or the name, likeness, image of any real person, other than yourself appears in the Fan Art, you acknowledge and agree that you have obtained, prior to uploading the Fan Art, any and all releases and/or consents necessary to permit the display, exhibition, and other use of the Fan Art or any portion as set forth in these Guidelines. Any real person appearing in the Fan Art must be at least 18 years of age, or the age of majority in the respective state of residence, at the time the Fan Art is created.
5. Fan Art must not contain any commercial or corporate advertising (e.g., corporate logos, brand names, slogans), recognizable branded products, or commercial artwork other than as the same may appear in UMGS Content, unless you are the rightful copyright holder of said commercial or corporate advertising.
DISCLAIMER: Under My Gorilla Studios ("UMGS") and its partners, affiliates, licensees, writers, and artists are constantly coming up with new adaptations and versions of GLO’s characters and related elements, so, if some day, you see something in a GLO update or on merchandise or in any image, film, television, or other production that reminds you of something that you included in your fan art, please understand that such similarity, in all likelihood, is coincidental, and, in any case, UMGS and its affiliates are not agreeing to credit or pay you for the use of any element or ideas similar to those in your artwork submission. All original illustrations or artwork you create and submit to UMGS or, at UMGS’ request, publicly share, tweet, post to any social media platform will be collectively referenced hereunder as the “Fan Art”. Fan Art meeting these Guidelines may be selected and shared by UMGS on any of UMGS’s social media pages, websites, email newsletters, or on any other platform or service owned or controlled by UMGS, and may be removed by UMGS at any time, at UMGS’ sole and absolute discretion. Fan Art shared, tweeted, or posted to any social media platform must be accompanied by the hashtag #GLOFANART, and UMGS may add, remove, or edit the hashtags for any Fan Art at UMGS’ sole and absolute discretion. You acknowledge and agree that there is no obligation to compensate or provide credit to you in any way for any use of the Fan Art by UMGS.
Please be aware that the following only applies to Ubu Red Studio, ウブレッドスタジオ ("URS"), for everyone else or any other entity please follow the "Fan Art Guidelines" above.
We've made a mutually beneficial agreement to license usage rights of Gorilla Labs Online's ("GLO") original character designs to URS, these are official and exact replicas of our most recent character models, they were reproduced in a way that does not infringe any third party licenses. With a few agreed upon exceptions (at UMGS’ sole and absolute discretion) URS is otherwise permitted to use our original characters in any context of commercial media including but not limited to Images, Videos, Doujinshi, Parodies, etc.
The usage of the GLO logo and name is also permitted to URS; only if the GLO logo or name is used is it required for UMGS to be credited as the creator and owner in the description of the media, if the place of upload does not have appropriate room for a description on each media file then it must be listed on the account's profile somewhere.
No third party may at their sole discretion determine if these terms have been violated and interfere with URS' business, instead they must reach out to UMGS first for UMGS to determine (at our sole and absolute discretion) any violations otherwise said third party may be infringing upon our agreement with URS. Lack of a timely response from UMGS does not constitute a violation.
This does not represent the whole nor complete agreement, instead it's purpose is to announce that there is in fact an agreement and license in place.
